A slip and fall case may arise where a hazardous situation is allowed to exist and as a direct and proximate result of the hazard someone slips and injures themselves. In order for one to be responsible for the hazard that person must have either caused the hazard to exist or must have a duty to detect the hazard and eliminate it. The mere fact that one falls does not bestow upon another responsibility for the injury which might be sustained.

If someone is attacked and bitten by a dog, the owner of the dog may be responsible for the injury of the bitten person. Traditionally in North Carolina one must show the dog has demonstrated a propensity for aggressiveness or has actually bitten before in order to collect. The law currently recognizes evidence, as admissible which would establish the aggressiveness of certain breeds. There have been some cases recognizing violation of leash and confinement laws as a basis for recovery of damages where those laws were deemed to have been enacted for public safety.

This act has been defined by Prosser in the Handbook of the Law of Torts as the "intentional placing of a person in reasonable apprehension of an imminent harmful or offensive contact." The many possibilities giving rise to a claim for assault are numerous to describe here but if one feels they have been assaulted they should speak with a lawyer experienced in this area of the law to determine if they have a claim which warrants pursuit.
